First you have marital property. Marital property is any property that was accumulated as a result of the couples marriage.
Common law property. Common law property is whoevers on title is on the principle that gets the rights to that property. Only property that is owned by both parties will be split accordingly. This law is mainly upheld in Mississippi. Check your state law for any of these definitions.
Community property is property that has been obtained from the couples overall income jointed together. This type of property is called community property. The spouse ending the marriage gets 50% of remaining equity. This law is in other states and not practiced in North Carolina or Charlotte.
Equitable Distribution is practiced in around 40 states, not sure if North Carolina is one of those states. The way equitable distribution works is the bread winner or leading income producer get 2/3’s of the property and the lower wages spouse gets the remaining one third. Note that the party responsible for the divorce may not get the full equitable share.
Separate Property. All 50 states permit separate property laws that allow the spouse that owned a particular property before the marriage to leave with the property at divorce. There are some rules but here a few:
property acquired before the marriage.
property traded for another property that was acquired before the marriage.
property obtained through premartial money.
inheritance to only one of the spouses.
property acquired during separation.
There more rules and bylaws but those listed are just a few.
